| relating to an exception to the application of the offense of | ||
| illegal voting. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 64.012, Election Code, is amended by | ||
| adding Subsection (c) to read as follows: | ||
| (c) It is an exception to the application of Subsection | ||
| (a)(1) that the person: | ||
| (1) voted or attempted to vote a provisional ballot in | ||
| accordance with Section 63.011; and | ||
| (2) did not know: | ||
| (A) of the particular circumstances that made the | ||
| person not eligible to vote in the election; or | ||
| (B) that those circumstances made the person not | ||
| eligible to vote in the election. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an offense committed on or after the effective date of this Act. | ||
| An offense committed before the effective date of this Act is | ||
| governed by the law in effect on the date the offense was committed, | ||
| and the former law is continued in effect for that purpose. For | ||
| purposes of this section, an offense was committed before the | ||
| effective date of this Act if any element of the offense occurred | ||
| before that date. | ||
| SECTION 3. This Act takes effect January 1, 2022. | ||
