relating to a local option election on the sale of alcoholic | ||
beverages in certain areas of a municipality and the local | ||
regulation of premises in those areas. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 251.742, Alcoholic Beverage Code, is | ||
amended by amending Subsection (b) and adding Subsection (i) to | ||
read as follows: | ||
(b) This section applies only to a municipality that: | ||
(1) has a population of 15,000 or more[ |

(A) has a population of 340,000 or more; and | ||
(B) borders the Gulf of Mexico; or | ||
(2) has a population of 240,000 or more and: | ||
(A) is located in two or more counties; and | ||
(B) borders a man-made lake that has a surface | ||
area of at least 20,000 acres. | ||
(i) Subject to Chapter 211, Local Government Code, the | ||
governing body of the municipality may adopt zoning and land use | ||
regulations applicable to a premises that sells alcoholic beverages | ||
in the boundaries of a zone designated under this section. | ||
SECTION 2. This Act takes effect September 1, 2023. |
