relating to the authority of certain minors to consent to Texas Home | ||
Visiting Program services and to the delivery of those services. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 531.982, Government Code, is amended by | ||
adding Subsections (d), (e), and (f) to read as follows: | ||
(d) A minor who is otherwise eligible for a home visiting | ||
program may consent to enrollment in and to receive services from a | ||
home visiting program. For purposes of this subsection, "minor" | ||
means an individual who is younger than 18 years of age. | ||
(e) A health professional or other person providing | ||
services under the home visiting program must obtain the express | ||
consent of the owner or adult occupant of the residence or property | ||
before the person may enter the residence or property to provide | ||
services under the program. | ||
(f) Subsection (d) does not authorize a health professional | ||
or other person providing services under the home visiting program | ||
to enter or remain in the residence or on the property of another in | ||
violation of Section 30.05, Penal Code. | ||
SECTION 2. This Act takes effect September 1, 2023. |
