relating to the use of alternate electronic reporting databases for | ||
over-the-counter sales of ephedrine, pseudoephedrine, and | ||
norpseudoephedrine. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 486.005, Health and Safety Code, is | ||
amended by amending Subsection (b) and adding Subsection (b-1) to | ||
read as follows: | ||
(b) Except as provided by Subsection (b-1), this [ |
||
chapter preempts and supersedes a local ordinance, rule, or | ||
regulation adopted by a political subdivision of this state | ||
pertaining to over-the-counter sales of products that contain | ||
ephedrine, pseudoephedrine, or norpseudoephedrine. | ||
(b-1) This section does not preclude a political | ||
subdivision from adopting an ordinance, rule, or regulation | ||
authorizing or requiring a business establishment in that political | ||
subdivision that engages in over-the-counter sales of products | ||
containing ephedrine, pseudoephedrine, or norpseudoephedrine to | ||
use an electronic reporting database in addition to any other | ||
reporting or recordkeeping required under this chapter. | ||
SECTION 2. This Act takes effect September 1, 2011. |
