| norpseudoephedrine. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 486.005, Health and Safety Code, is | ||
| amended by amending Subsection (b) and adding Subsection (b-1) to | ||
| read as follows: | ||
| (b) Except as provided by Subsection (b-1), this [ |
||
| chapter preempts and supersedes a local ordinance, rule, or | ||
| regulation adopted by a political subdivision of this state | ||
| pertaining to over-the-counter sales of products that contain | ||
| ephedrine, pseudoephedrine, or norpseudoephedrine. | ||
| (b-1) This section does not preclude a political | ||
| subdivision from adopting an ordinance, rule, or regulation | ||
| authorizing or requiring a business establishment in that political | ||
| subdivision that engages in over-the-counter sales of products | ||
| containing ephedrine, pseudoephedrine, or norpseudoephedrine to | ||
| use an electronic reporting database in addition to any other | ||
| reporting or recordkeeping required under this chapter. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
