| relating to the employment of physicians by hospital districts. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 285, Health and Safety Code, is amended | ||
| by adding Subchapter P to read as follows: | ||
| SUBCHAPTER P. EMPLOYMENT OF PHYSICIANS | ||
| Sec. 285.331. EMPLOYMENT OF PHYSICIANS PERMITTED. (a) A | ||
| hospital district created under general or special law may employ a | ||
| physician and retain all or part of the professional income | ||
| generated by the physician for medical services provided at a | ||
| hospital or health care facility owned or operated by the hospital | ||
| district. | ||
| (b) This section may not be construed as authorizing a | ||
| hospital district to supervise or control the practice of medicine, | ||
| as prohibited by Subtitle B, Title 3, Occupations Code. | ||
| Sec. 285.332. CREDENTIALING AND PRIVILEGES. A physician | ||
| employed by a hospital district under Section 285.331 is subject to | ||
| the same standards and procedures regarding credentialing, peer | ||
| review, quality of care, and privileges as a physician not employed | ||
| by the hospital district. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
