| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 250.006(c), Local Government Code, is | ||
| amended to read as follows: | ||
| (c) The order or ordinance must require a property owner to | ||
| remove the graffiti on or before the 10th [ |
||
| the property owner receives notice under Subsection (a). If the | ||
| property owner fails to remove the graffiti on or before the 10th | ||
| [ |

| municipality may remove the graffiti and charge the expenses of | ||
| removal to the property owner in accordance with a fee schedule | ||
| adopted by the county or municipality. | ||
| SECTION 2. Section 250.006(b), Local Government Code, is | ||
| repealed. | ||
| SECTION 3. The change in law made by this Act applies only | ||
| to an order or ordinance adopted on or after the effective date of | ||
| this Act. An order or ordinance adopted before the effective date | ||
| of this Act is governed by the law in effect on the date the order or | ||
| ordinance was adopted, and that law is continued in effect for that | ||
| purpose. | ||
| SECTION 4. This Act takes effect September 1, 2023. | ||
