| relating to the punishment for the offense of murder committed by a | ||
| peace officer; increasing a criminal penalty. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 19.02, Penal Code, is amended by | ||
| amending Subsection (c) and adding Subsection (c-1) to read as | ||
| follows: | ||
| (c) Subject to Subsection (c-1) and except [ |
||
| provided by Subsection (d), an offense under this section is a | ||
| felony of the first degree. | ||
| (c-1) Except as provided by Subsection (d), an offense under | ||
| this section is a felony of the first degree with a minimum term of | ||
| imprisonment of 15 years if the offense is committed by a peace | ||
| officer acting under the authority of the state or a political | ||
| subdivision of the state. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an offense committed on or after the effective date of this Act. | ||
| An offense committed before the effective date of this Act is | ||
| governed by the law in effect when the offense was committed, and | ||
| the former law is continued in effect for that purpose. For purposes | ||
| of this section, an offense was committed before the effective date | ||
| of this Act if any element of the offense occurred before that date. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
