of Public Safety concerning the enforcement of federal immigration | ||
laws. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 411, Government Code, is | ||
amended by adding Section 411.00961 to read as follows: | ||
Sec. 411.00961. MEMORANDUM OF UNDERSTANDING WITH UNITED | ||
STATES DEPARTMENT OF HOMELAND SECURITY; TRAINING. (a) The | ||
department shall require that each peace officer employed by the | ||
department be trained in accordance with a memorandum of | ||
understanding between this state and the United States Department | ||
of Homeland Security concerning the law enforcement officer's role | ||
in enforcing federal immigration laws, in accordance with 8 U.S.C. | ||
Section 1357(g). | ||
(b) The director has authority to negotiate the terms of the | ||
memorandum described by Subsection (a). | ||
(c) A memorandum described by Subsection (a) must be signed | ||
by the director and by the governor. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
