relating to the restoration of certain inmates' good conduct time | ||
that is forfeited during a term of imprisonment. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 498.004(a), Government Code, is amended | ||
to read as follows: | ||
(a) If, during the actual term of imprisonment of an inmate | ||
in the department or in a transfer facility, the inmate commits an | ||
offense or violates a rule of the department, the department may | ||
forfeit all or any part of the inmate's accrued good conduct time | ||
or, in accordance with the policy adopted under Subsection (c), | ||
place all or any part of the inmate's accrued good conduct time in | ||
suspension. The department [ |

time suspended under this subsection and, unless an inmate is | ||
serving a sentence for an offense listed in Section 508.149(a), may | ||
restore good conduct time forfeited under this subsection. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
