| failure to obey a court order related to truancy. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 25.094, Education Code, is amended by | ||
| adding Subsection (h) to read as follows: | ||
| (h) Notwithstanding any other law, an individual found in | ||
| contempt of court, or adjudicated to have engaged in delinquent | ||
| conduct that would constitute contempt of court, for failure to | ||
| obey a court order related to an offense under Subsection (a) may | ||
| not be punished for the contempt or delinquent conduct by | ||
| confinement in jail or detention in a juvenile detention facility. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to conduct that would constitute contempt of court that occurs on or | ||
| after the effective date of this Act. Conduct that would constitute | ||
| contempt of court that occurred before the effective date of this | ||
| Act is governed by the law in effect on the date the conduct | ||
| occurred, and the former law is continued in effect for that | ||
| purpose. For purposes of this section, conduct occurred before the | ||
| effective date of this Act if any element of the conduct occurred | ||
| before that date. | ||
| SECTION 3. This Act takes effect September 1, 2015. | ||
