relating to requirements regarding electronic access to | ||
instructional materials provided in printed book format purchased | ||
for public schools. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 31, Education Code, is | ||
amended by adding Section 31.036 to read as follows: | ||
Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN | ||
ELECTRONIC FORMAT. (a) This section applies only to instructional | ||
materials or supplemental instructional materials provided in | ||
printed book format. | ||
(b) The publisher of instructional materials or | ||
supplemental instructional materials subject to this section | ||
purchased as provided by this chapter for a school district shall | ||
provide the district at no additional cost with access to the | ||
materials in an electronic format as provided by this section. | ||
(c) Instructional materials or supplemental instructional | ||
materials may be accessed in an electronic format under this | ||
section only for educational purposes by: | ||
(1) students enrolled in a course or subject for which | ||
the materials were purchased for the purpose of completing that | ||
course or subject and only for the period during which the student | ||
is enrolled; | ||
(2) teachers providing instruction in a course or | ||
subject for which the materials were purchased for the purpose of | ||
providing that instruction and only for the period during which the | ||
materials in printed book format are assigned for that course or | ||
subject; and | ||
(3) school and district administrators for a district | ||
campus at which a course or subject for which the materials were | ||
purchased is provided and only for the period during which the | ||
materials in printed book format are assigned for that course or | ||
subject. | ||
(d) The commissioner shall adopt rules to administer this | ||
section. | ||
SECTION 2. The change in law made by this Act applies only | ||
to instructional materials or supplemental instructional materials | ||
purchased under a contract entered into on or after the effective | ||
date of this Act. Instructional materials or supplemental | ||
instructional materials purchased under a contract entered into | ||
before the effective date of this Act are governed by the law in | ||
effect on the date the contract was entered into, and the former law | ||
is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
