| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 29.255, Education Code, is amended by | ||
| adding Subsection (c) to read as follows: | ||
| (c) Notwithstanding any other provision of this subchapter, | ||
| the agency shall allocate state and federal adult basic education | ||
| funds, other than federal funds set aside for state administration, | ||
| special projects, and staff development, on the following basis: | ||
| (1) 75 percent of the funds available shall be | ||
| allocated based on the best available estimates of the number of | ||
| eligible adults in each county and school district geographic area | ||
| within each county; and | ||
| (2) 25 percent of the funds available shall be | ||
| allocated based on student contact hours reported by each school | ||
| district geographic area for the most recent complete fiscal year | ||
| reporting period. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
