BACKGROUND AND PURPOSE

 

The 82nd Legislature passed bills that repealed a statute that governs the issuance of specialty license plates to state and federal judges and amended parts of the same statute. H.B. 5076 seeks to resolve any potential ambiguity about the law as amended by those bills by reenacting statutory provisions to ensure state judges may qualify for state judge license plates and expanding the class of judges eligible for state judge license plates.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 5076 amends the Transportation Code to include a statutory probate court judge, an associate judge of a district or statutory county court, a justice of the peace, a municipal judge, and a constitutional county court judge among the judges eligible to be issued state judge  specialty license plates by the Texas Department of Motor Vehicles.
