Amend SB 3 (house committee report) on page 9, between lines 1 and 2, by inserting the following appropriately lettered subsection and relettering subsequent subsections accordingly:
(____) This section may not be construed in a manner that would prevent teachers, administrators, or other employees of a school district, open-enrollment charter school, or state agency from using bullying harassment prevention and mediation strategies, including strategies adopted in school district bullying policies under Section 37.0832(c), to address specific instances or school-wide cultures of bullying or harassment based on or targeting a student because of that student's:
(1) actual or perceived race, color, national origin, ethnicity, gender identity, gender expression, disability status, or sexual orientation; or
(2) association with a person with one or more of the actual or perceived characteristics described by Subdivision (1).
