Amend CSHB 45 (house committee report) as follows:
(1) On page 1, line 15, strike "shall simultaneously" and substitute "may, if the local prosecuting attorney consents,".
(2) On page 1, line 18, strike "or law enforcement agency shall" and substitute "or, if the local prosecuting attorney consents, a law enforcement agency may".
(3) On page 1, line 21, strike "required" and substitute "authorized".
(4) On page 1, line 23, strike "jurisdiction to prosecute and shall" and substitute "concurrent jurisdiction with the local prosecuting attorney to prosecute and may".
(5) On page 2, between lines 1 and 2, insert the following appropriately numbered subdivision to added Section 402.103, Government Code, and renumber subsequent subdivisions of that section accordingly:
(____) the local prosecuting attorney consents;
(6) On page 2, line 11, strike "jurisdiction to prosecute and shall" and substitute "concurrent jurisdiction with the local prosecuting attorney to prosecute and may".
