Amend CSHB 4290 (house committee printing) on page 1 as follows:

(1)  On lines 12 through 14, strike "Unless the qualifying cogenerator is a municipally owned utility or an electric cooperative, the" and substitute "The".

(2)  On line 17, strike "and".

(3)  On line 19, strike the underlined period and substitute "; and".

(4)  Between lines 19 and 20, insert the following:

(C)  is not located in an area in which a municipally owned utility or electric cooperative is certificated to provide retail electric utility service.
