A bill
TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 31-17-310, RELATING TO THE DEFINITION OF MOBILE HOME, SO AS TO PROVIDE A DEFINITION; AND BY AMENDING SECTION 31-17-320, RELATING TO LICENSE REQUIREMENTS FOR MOBILE HOMES, SO AS TO PROVIDE SEPARATE REQUIREMENTS FOR THE ISSUING OF A LICENSE FOR A MOBILE HOME TO A LICENSED DEALER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 31-17-310 of the S.C. Code is amended to read:
Section 31-17-310. "Mobile home" as used in this article shall have the same meaning assigned as manufactured home in Section 31-17-2040-29-20(9).
SECTION 2. Section 31-17-320(B) of the S.C. Code is amended to read:
(B)(1) Before When issuing a license for a mobile home to be located in any county in this State to a person who is not a licensed mobile home dealer, the licensing agent shall first require from the person applying for the license either a copy of the certificate of title to the mobile home, or a copy of the completed application for a certificate of title submitted to the Department of Motor Vehicles. Upon satisfaction of all county licensing requirements, including payment of any licensing fee, the county licensing agent shall give the license applicant a certified copy of the application form, indicating that the licensing requirements have been met.; or
(2) When issuing a license for a mobile home to be located in any county in this State to a licensed manufactured home dealer, the county shall first require a:
(a) fully-executed sales agreement as prescribed by law;
(b) copy of the licensed manufacturer's certificate of origin;
(c) copy of the title application to be filed with the South Carolina Department of Motor Vehicles upon completion of construction; and
(d) statement written on the licensed dealer's letterhead, signed by the dealer or his representative, and noting the licensed dealer's state ID number certifying that the licensed dealer will title the home upon completion of the project.
SECTION 3. This act takes effect upon approval by the Governor.
