A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-620 SO AS TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION MUST MAINTAIN ANY OUTFALL OR DRAINAGE DITCH THAT WAS CONSTRUCTED BY THE DEPARTMENT AS PART OF A STATE HIGHWAY CONSTRUCTION PROJECT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 7, Chapter 3, Title 57 of the 1976 Code is amended by adding:

"Section 57-3-620. Notwithstanding another provision of law, any outfall or drainage ditch that was constructed by the Department of Transportation as part of a state highway construction project must be maintained by the department."

SECTION 2. This act takes effect upon approval by the Governor.
