A BILL
TO CREATE THE ACADEMIC STANDARDS AND ASSESSMENT COMMITTEE TO MAKE RECOMMENDATIONS TO THE GENERAL ASSEMBLY REGARDING THE BEST MANNER BY WHICH THE ACADEMIC STANDARDS MAY BE ASSESSED WITHOUT INTERFERING WITH EDUCATIONAL INSTRUCTION; AND TO REPEAL CHAPTER 18, TITLE 59, RELATING TO THE EDUCATION ACCOUNTABILITY ACT, UNLESS SUBSEQUENT RELATED LEGISLATION IS ENACTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) There is created the Academic Standards and Assessment Committee to determine the best manner by which the academic standards may be assessed and reported without interfering with educational instruction. The committee shall review the current process by which standards are set and assessed and explore alternative and less intrusive means. The committee shall make recommendations to the General Assembly by January 15, 2021.
(B) The committee must be composed of:
(1) one member appointed by the Superintendent of Education;
(2) one member appointed by the Chairman of the Education Oversight Committee;
(3) one member appointed by the Chairman of the Senate Education Committee;
(4) one member appointed by the Chairman of the House Education and Public Works Committee; and
(5) one member appointed by the Governor.
Each member of the committee must have experience in public education as a teacher, guidance counselor, or administrator. A member may not be a member of the General Assembly.
(C) The staff of the Department of Education shall assist the committee in its work.
(D) The committee members are entitled to such mileage, subsistence, and per diem as authorized by law for members of boards, committees, and commissions while in the performance of the duties for which appointed.
(E) Upon its making recommendations to the General Assembly, the committee is dissolved.
SECTION 2. A. Chapter 18, Title 59 of the 1976 Code is repealed unless legislation is enacted that provides a means by which academic standards may be assessed and reported or unless the chapter is reauthorized.
B. This SECTION takes effect July 1, 2022, and first applies to the 2022-2023 School Year.
SECTION 3. Except where specified otherwise, this act takes effect upon approval by the Governor.
