AN ACT

Amending Title 66 (Public Utilities) of the Pennsylvania

2

Consolidated Statutes, providing for whistle post signage.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Title 66 of the Pennsylvania Consolidated

6

Statutes is amended by adding a section to read:

7

§ 2710.  Whistle post signage.

8

(a)  Duty.--A public utility engaged in a railroad business

9

shall place whistle post signs to the right of the main track in

10

the direction of approach exactly one-quarter of a mile from the

11

entrance to crossings to notify engineers or operators of

12

locomotives who blow a whistle and ring a bell as the locomotive

13

approaches the crossing as a warning to the public.

14

(b)  Signs.--The whistle post signs shall consist of a "W"

15

identifiable on a square plate mounted on a post and shall be:

16

(1)  Visible to an engineer or operator of a locomotive

17

within the cabin or caboose car.

(2)  Kept in good repair.

2

(3)  Replaced promptly when necessary.

Section 2.  This act shall take effect in 60 days.
