| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," providing, in funding for public |
6 | libraries, for State aid for 2009-2010. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
10 | as the Public School Code of 1949, is amended by adding a |
11 | section to read: |
12 | Section 2318. State aid for 2009-2010. |
13 | (a) General rule.--Notwithstanding any other provision of |
14 | law, the following apply: |
15 | (1) Subject to paragraph (2), each library subject to |
16 | the act of June 14, 1961 (P.L.324, No.188), known as The |
17 | Library Code, that received a State aid allocation for fiscal |
18 | year 2008-2009 under section 2317 shall be eligible for State |
19 | aid in fiscal year 2009-2010. |
20 | (2) Any newly designated district library centers shall |

1 | be eligible for State aid in lieu of their predecessor |
2 | district library centers. |
3 | (b) Formula.--State aid under this section shall consist of |
4 | the following formula: |
5 | (1) Divide: |
6 | (i) the sum of the amount of funding that the |
7 | library received in fiscal year 2007-2008 under section |
8 | 2316; by |
9 | (ii) the total State aid subsidy for fiscal year |
10 | 2007-2008. |
11 | (2) Multiply: |
12 | (i) the quotient under paragraph (1); by |
13 | (ii) the total State aid subsidy for 2009-2010. |
14 | (c) State Librarian.--After distribution of State aid to |
15 | libraries under this section, any remaining unallocated funds |
16 | may be distributed at the discretion of the State Librarian. |
17 | (d) Local distribution.--Each library system receiving State |
18 | aid under this section may distribute the local library share of |
19 | that aid in a manner as determined by the system board of |
20 | directors. |
21 | (e) Waiver.--Upon application of the board of directors of a |
22 | local library, the State Librarian may waive any or all of the |
23 | provisions of section 104 of The Library Code. The application |
24 | must be in a form and manner as specified by the State Librarian |
25 | and must demonstrate that meeting the standards places an |
26 | economic hardship on the library. |
27 | Section 2. This act shall take effect in 60 days. |
