AN ACT

Amending Titles 24 (Education) and 71 (State Government) of the

2

Pennsylvania Consolidated Statutes, in membership,

3

contributions and benefits, further providing for eligibility

4

for limited early retirement.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 8313 of Title 24 of the Pennsylvania

8

Consolidated Statutes is amended to read:

9

§ 8313.  Eligibility for limited early retirement.

10

Notwithstanding any provisions of this title to the contrary,

11

the following early retirement provisions shall be applicable to

12

eligible members:

13

(1)  Any member who, during the period of time from the

14

effective date of this section through July 10, 1998:

15

(i)  has credit for at least 30 eligibility points;

16

(ii)  terminates school service; and

17

(iii)  files an application for an annuity with an

18

effective date of retirement not later than July 11,

19

shall be entitled to receive a maximum single life annuity

2

calculated pursuant to section 8342 (relating to maximum

3

single life annuity) without any reduction by virtue of an

4

effective date of retirement which is under the

5

superannuation age.

(2)  Any member who, during the period of time from April

7

1, 1999, through June 30, 1999:

8

(i)  has credit for at least 30 eligibility points;

9

(ii)  terminates school service; and

10

(iii)  files an application for an annuity with an

11

effective date of retirement not later than July 1, 1999,

12

shall be entitled to receive a maximum single life annuity

13

calculated pursuant to section 8342 without any reduction by

14

virtue of an effective date of retirement which is under the

15

superannuation age.

16

(3)  Any member who, during the period of time from April

17

1, 2009, through June 30, 2009:

18

(i)  has credit for at least 30 eligibility points;

19

(ii)  terminates school service; and

20

(iii)  files an application for an annuity with an

21

effective date of retirement not later than July 1, 2009,

22

shall be entitled to receive a maximum single life annuity

23

calculated pursuant to section 8342 without any reduction by

24

virtue of an effective date of retirement which is under the

25

superannuation age.

26

(4)  Any member who, during the period of time from April

27

1, 2010, through June 30, 2010:

28

(i)  has credit for at least 30 eligibility points;

29

(ii)  terminates school service; and

30

(iii)  files an application for an annuity with an

effective date of retirement not later than July 1, 2010,

2

shall be entitled to receive a maximum single life annuity

3

calculated pursuant to section 8342 without any reduction by

4

virtue of an effective date of retirement which is under the

5

superannuation age.

Section 2.  Section 5308.2 of Title 71 is amended to read:

7

§ 5308.2.  Eligibility for limited early retirement.

Notwithstanding any provisions of this title to the

9

contrary[, any]:

10

(1)  Any eligible member who, during the period of time

11

from July 1, 1998, through June 30, 1999:

12

[(1)] (i)  has credit for at least 30 eligibility points;

13

[(2)] (ii)  terminates State service; and

14

[(3)] (iii)  files an application for an annuity with an

15

effective date of retirement not later than July 1, 1999,

16

shall be entitled to receive a maximum single life annuity

17

calculated pursuant to section 5702 (relating to maximum

18

single life annuity) without any reduction by virtue of an

19

effective date of retirement which is under the

20

superannuation age.

21

(2)  Any eligible member who, during the period of time

22

from July 1, 2009, through June 30, 2010:

23

(i)  has credit for at least 30 eligibility points;

24

(ii)  terminates State service; and

25

(iii)  files an application for an annuity with an

26

effective date of retirement not later than July 1, 2010,

27

shall be entitled to receive a maximum single life annuity

28

calculated pursuant to section 5702 without any reduction by

29

virtue of an effective date of retirement which is under the

30

superannuation age.

Section 3.  This act shall take effect immediately.
