AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in criminal homicide, further

3

providing for the offense of involuntary manslaughter.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 2504(b) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 2504.  Involuntary manslaughter.

(b)  Grading.--[Involuntary]

11

(1)  Except as otherwise provided in this subsection,

12

involuntary manslaughter is a misdemeanor of the first

13

degree.

14

(2)  Where the victim is under 12 years of age and is in

15

the care, custody or control of the person who caused the

16

death, involuntary manslaughter is a felony of the second

17

degree.

(3)  Where the victim is in need of medical care and the

person caused the death by denying the victim medical care

2

through act or omission, involuntary manslaughter is a felony

3

of the second degree.

4

Section 2.  This act shall take effect in 60 days.
