AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, in accidents and accident reports, further

3

providing for duty to give information and render aid.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3744(c) of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended and the section is amended by

adding a subsection to read:

§ 3744.  Duty to give information and render aid.

(c)  Duty of occupants [if driver disabled].--Whenever the

12

driver of a vehicle is physically unable, refuses or neglects to

13

give the information or assistance required in this section and

14

there are other occupants in the vehicle at the time of the

15

accident who are physically able to give the information or

16

assistance required in this section, each of the other occupants

17

shall fully reveal the identity of himself and the identity of

18

the driver of the vehicle and of the owner of the vehicle of

which they are occupants and shall otherwise perform the duties

2

of the driver as set forth in subsection (a).

(d)  Penalties.--

(1)  Any driver violating this section commits a

5

misdemeanor of the third degree and shall, upon conviction,

6

be sentenced to pay a fine of not more than $2,500.

7

(2)  Any occupant violating this section commits a

8

summary offense and shall, upon conviction, be sentenced to

9

pay a fine of not more than $300.

10

Section 2.  This act shall take effect in 60 days.
