| AN ACT |
| |
1 | Amending the act of April 14, 1972 (P.L.221, No.63), entitled, |
2 | as amended, "An act establishing the Pennsylvania Advisory |
3 | Council on Drug and Alcohol Abuse; imposing duties on the |
4 | Department of Health to develop and coordinate the |
5 | implementation of a comprehensive health, education and |
6 | rehabilitation program for the prevention and treatment of |
7 | drug and alcohol abuse and drug and alcohol dependence; |
8 | providing for emergency medical treatment; providing for |
9 | treatment and rehabilitation alternatives to the criminal |
10 | process for drug and alcohol dependence; and making repeals," |
11 | further providing for definitions; and providing for opioid |
12 | addiction treatment. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. Section 2 of the act of April 14, 1972 (P.L.221, |
16 | No.63), known as the Pennsylvania Drug and Alcohol Abuse Control |
17 | Act, amended December 20, 1985 (P.L.529, No.119) and November |
18 | 26, 1997 (P.L.501, No.53), is amended to read: |
19 | Section 2. Definitions: |
20 | (a) The definitions contained and used in the Controlled |
21 | Substance, Drug, Device and Cosmetic Act shall also apply for |
22 | the purposes of this act. |

1 | (b) As used in this act: |
2 | "Bureau" means the Bureau of Drug and Alcohol Programs in the |
3 | Department of Health, or any successor entity which becomes |
4 | responsible for opioid treatment programs. |
5 | "Controlled Substance" means a drug, substance, or immediate |
6 | precursor in Schedules I through V of the Controlled Substance, |
7 | Drug, Device and Cosmetic Act. |
8 | "Council" means the Pennsylvania Advisory Council on Drug and |
9 | Alcohol Abuse established by this act and transferred to the |
10 | Department of Health by Reorganization Plan No. 4 on April 21, |
11 | 1981. |
12 | "Court" means all courts of the Commonwealth of Pennsylvania, |
13 | including magistrates and justices of the peace. |
14 | "Department" means the Department of Health. |
15 | "Division" means the Division of Drug and Alcohol Program |
16 | Licensure within the Department of Health or any successor |
17 | entity which becomes responsible for licensing drug or alcohol |
18 | programs. |
19 | "Drug" means (i) substances recognized in the official United |
20 | States Pharmacopeia, or official National Formulary, or any |
21 | supplement to either of them; and (ii) substances intended for |
22 | use in the diagnosis, cure, mitigation, treatment or prevention |
23 | of disease in man or other animals; and (iii) substances (other |
24 | than food) intended to affect the structure or any function of |
25 | the body of man or other animals; and (iv) substances intended |
26 | for use as a component of any article specified in clause (i), |
27 | (ii) or (iii), but not including devices or their components, |
28 | parts or accessories. |
29 | "Drug abuser" means any person who uses any controlled |
30 | substance under circumstances that constitute a violation of the |

1 | law. |
2 | "Drug dependent person" means a person who is using a drug, |
3 | controlled substance or alcohol, and who is in a state of |
4 | psychic or physical dependence, or both, arising from |
5 | administration of that drug, controlled substance or alcohol on |
6 | a continuing basis. Such dependence is characterized by |
7 | behavioral and other responses which include a strong compulsion |
8 | to take the drug, controlled substance or alcohol on a |
9 | continuous basis in order to experience its psychic effects, or |
10 | to avoid the discomfort of its absence. This definition shall |
11 | include those persons commonly known as "drug addicts." |
12 | "Emergency medical services" includes all appropriate short |
13 | term services for the acute effects of abuse and dependence |
14 | which: (i) are available twenty-four hours a day; (ii) are |
15 | community based and located so as to be quickly and easily |
16 | accessible to patients; (iii) are affiliated with and constitute |
17 | an integral (but not necessarily physical) part of the general |
18 | medical services of a general hospital; and (iv) provide drug |
19 | and alcohol withdrawal and other appropriate medical care and |
20 | treatment, medical examination, diagnosis, and classification |
21 | with respect to possible dependence, and referral for other |
22 | treatment and rehabilitation. |
23 | "Government attorney" means an attorney authorized to |
24 | represent the Commonwealth or any political subdivision in any |
25 | judicial proceeding within the scope of this act. |
26 | "Inpatient services" includes all treatment and |
27 | rehabilitation services for drug and alcohol abuse and |
28 | dependence provided for a resident patient while the patient |
29 | spends full time in a treatment institution including but not |
30 | limited to a hospital, rehabilitative center or residential |

1 | facility. |
2 | "Methadone" means a synthetic opioid agonist which binds with |
3 | opioid receptors in the brain to initiate drug actions that |
4 | mimic the effects of opiates. |
5 | "Minor" means any person under the age of eighteen years. |
6 | "Narcotic treatment program" means a program for chronic drug |
7 | users that either administers or dispenses agents under a |
8 | narcotic treatment physician's order for detoxification or |
9 | maintenance purposes or provides a comprehensive range of |
10 | medical and rehabilitative services to alleviate adverse |
11 | medical, psychological or physical effects incident to an |
12 | addiction to narcotics or does both. |
13 | "Opioid addiction treatment" means a narcotic treatment |
14 | program that involves the dispensing of an opioid agonist or |
15 | antagonist treatment medication, along with appropriate or |
16 | necessary medical and rehabilitative services, to an individual |
17 | to alleviate the adverse medical, psychological or physical |
18 | effects incident to opiate addiction. This term encompasses |
19 | detoxification treatment, short-term detoxification treatment, |
20 | long-term detoxification treatment, maintenance treatment, |
21 | comprehensive maintenance treatment and interim maintenance |
22 | treatment. |
23 | "Outpatient services" means all treatment and rehabilitation |
24 | services, including but not limited to medical, psychological, |
25 | vocational and social rehabilitational services, for drug and |
26 | alcohol abuse and dependence provided while the patient is not a |
27 | resident of a treatment institution. |
28 | "Prevention, intervention and treatment" means all |
29 | appropriate forms of educational programs and services |
30 | (including but not limited to radio, television, films, books, |

1 | pamphlets, lectures, adult education and school courses); |
2 | planning, coordinating, statistical, research, training, |
3 | evaluation, reporting, classification, and other administrative, |
4 | scientific or technical programs or services; and screening, |
5 | diagnosis, treatment (emergency medical services, inpatient |
6 | services, intermediate care and outpatient services), vocational |
7 | rehabilitation, job training and referral, and other |
8 | rehabilitation programs or services. |
9 | "State plan" means the master State plan for the control, |
10 | prevention, treatment, rehabilitation, research, education and |
11 | training aspects of drug and alcohol abuse and dependence |
12 | problems. |
13 | "Welfare assistance" means "assistance" as defined in section |
14 | 402 of the Public Welfare Code and "State Blind Pension" as |
15 | defined by section 502 of the Public Welfare Code. |
16 | Section 2. The act is amended by adding a section to read: |
17 | Section 4.1. Opioid Addiction Treatment.--The department, in |
18 | conjunction with the bureau and the council, shall develop and |
19 | adopt standards for providers of opioid addiction treatment |
20 | programs to address risks presented on this Commonwealth's |
21 | roadways by persons prescribed methadone. At a minimum, the |
22 | standards shall: |
23 | (1) Require a methadone clinic or provider who prescribes |
24 | methadone to immediately revoke any take-home permissions upon |
25 | notice of arrest or conviction of a patient for driving under |
26 | the influence. |
27 | (2) Prohibit a methadone clinic or provider from prescribing |
28 | an initial dose of methadone or increasing a methadone dosage by |
29 | more than 10 milligrams, unless the patient has made |
30 | arrangements for a designated driver. |

1 | (3) Require regular testing for any and all legal or illegal |
2 | substances which, in combination with methadone, would increase |
3 | the probability of impaired driving. |
4 | Section 3. This act shall take effect in 60 days. |
