| AN ACT |
| |
1 | Amending the act of October 6, 1998 (P.L.705, No.92), entitled, |
2 | as amended, "An act providing for the creation of keystone |
3 | opportunity zones and keystone opportunity expansion zones to |
4 | foster economic opportunities in this Commonwealth, to |
5 | facilitate economic development, stimulate industrial, |
6 | commercial and residential improvements and prevent physical |
7 | and infrastructure deterioration of geographic areas within |
8 | this Commonwealth; authorizing expenditures; providing tax |
9 | exemptions, tax deductions, tax abatements and tax credits; |
10 | creating additional obligations of the Commonwealth and local |
11 | governmental units; and prescribing powers and duties of |
12 | certain State and local departments, agencies and officials," |
13 | further providing for legislative findings and for |
14 | definitions; providing for application limited to areas of |
15 | extreme urban blight, for monitoring data and for periodic |
16 | audit; further providing for criteria for authorization of |
17 | keystone opportunity zone; providing for duties of |
18 | department; and further providing for reporting. |
19 | The General Assembly of the Commonwealth of Pennsylvania |
20 | hereby enacts as follows: |
21 | Section 1. Section 102 of the act of October 6, 1998 |
22 | (P.L.705, No.92), known as the Keystone Opportunity Zone, |
23 | Keystone Opportunity Expansion Zone and Keystone Opportunity |
24 | Improvement Zone Act, amended December 20, 2000 (P.L.841, |
25 | No.119), is amended to read: |
26 | Section 102. Legislative findings. |

1 | (1) There exist in this Commonwealth areas of economic |
2 | distress characterized by high unemployment, low investment |
3 | of new capital, inadequate dwelling conditions, blighted |
4 | conditions, underutilized, obsolete or abandoned industrial, |
5 | commercial and residential structures and deteriorating tax |
6 | bases. |
7 | (2) These areas require coordinated efforts by private |
8 | and public entities to restore prosperity and enable the |
9 | areas to make significant contributions to the economic and |
10 | social life of this Commonwealth. |
11 | (3) Long-term economic viability of these areas requires |
12 | the cooperative involvement of residents, businesses, State |
13 | and local elected officials and community organizations and |
14 | requires additional personnel for rural areas lacking good |
15 | economic development prospects. It is in the best interest of |
16 | the Commonwealth to assist and encourage the creation of |
17 | keystone opportunity zones and keystone opportunity expansion |
18 | zones and to provide temporary relief from certain taxes |
19 | within the zones to accomplish the purposes of this act. |
20 | Section 2. The definition of "business" in section 103 of |
21 | the act, amended December 20, 2000 (P.L.841, No.119), is amended |
22 | to read: |
23 | Section 103. Definitions. |
24 | The following words and phrases when used in this act shall |
25 | have the meanings given to them in this section unless the |
26 | context clearly indicates otherwise: |
27 | "Business." An association, partnership, corporation, sole |
28 | proprietorship, limited liability company or employer other than |
29 | a provider of professional services, including, but not limited |
30 | to, legal or accounting services. |

2 | Section 3. The act is amended by adding sections to read: |
3 | Section 301.7. Application limited to areas of extreme urban |
4 | blight. |
5 | (a) General rule.--Notwithstanding any other provision of |
6 | this act, keystone opportunity zones may be established after |
7 | the effective date of this section only in areas of extreme |
8 | urban blight. |
9 | (b) Definition.--For purposes of this section, "extreme |
10 | urban blight" shall mean a state of deterioration or decay in |
11 | property so severe as to cause the property to be essentially |
12 | worthless or commercially undesirable if not for the special |
13 | benefits granted under the provisions of this act. |
14 | Section 301.8. Monitoring data. |
15 | In addition to any other requirements of this act, the |
16 | department shall keep track of all of the following: |
17 | (1) Verifiable job creation and job retention data, |
18 | including net overall employment figures. |
19 | (2) Information on the types of jobs created and average |
20 | hourly wages. |
21 | (3) Number of years in the program. |
22 | (4) Annual, unduplicated public and private capital |
23 | investment amounts. |
24 | (5) Status of program participant, including whether the |
25 | participant is a new business start-up, relocation from |
26 | within Pennsylvania, move-in from out-of-State or expansion |
27 | of existing business. |
28 | (6) Business type and description, including SIC code. |
29 | (7) Program cost at both the State and local levels, |
30 | including an estimate of county, local and school taxes |

1 | foregone. |
2 | (8) Types and amounts of other economic development |
3 | assistance received from the department. |
4 | (9) Documentation of progress concerning the applicant's |
5 | compliance, or failure to comply, with payment of local taxes |
6 | and with code requirements. |
7 | (10) Documentation that proper participants identified |
8 | as relocations meet the increased full-time employment, |
9 | increased capital investment or lease agreement requirements |
10 | of this act. |
11 | Section 301.9. Periodic audit. |
12 | The keystone opportunity zone program shall undergo an |
13 | independent audit every two years. The first audit shall be |
14 | concluded within one year of the effective date of this section. |
15 | Section 4. Section 304(a) of the act, amended December 9, |
16 | 2002 (P.L.1727, No.217), is amended to read: |
17 | Section 304. Criteria for authorization of keystone opportunity |
18 | zone. |
19 | (a) Specific criteria.--In order to qualify for |
20 | authorization under this act, the proposed keystone opportunity |
21 | zone or proposed keystone opportunity expansion zone shall meet |
22 | at least [two] six of the following criteria: |
23 | (1) At least 20% of the population is below the poverty |
24 | level. |
25 | (2) The unemployment rate is 1.25 times the Statewide |
26 | average. |
27 | (3) At least 20% of all real property within a five-mile |
28 | radius of the proposed keystone opportunity zone, proposed |
29 | keystone opportunity expansion zone, proposed subzone or |
30 | proposed expansion subzone in a nonurban area is deteriorated |

1 | or underutilized. |
2 | (4) At least 20% of all real property within a one-mile |
3 | radius of the proposed keystone opportunity zone, proposed |
4 | keystone opportunity expansion zone, proposed subzone or |
5 | proposed expansion subzone in an urban area is deteriorated |
6 | or underutilized. |
7 | (5) At least 20% of all occupied housing within a two- |
8 | mile radius of the proposed keystone opportunity zone, |
9 | proposed keystone opportunity expansion zone, proposed |
10 | subzone or proposed expansion subzone in a nonurban area is |
11 | deteriorated. |
12 | (6) At least 20% of all occupied housing within a one- |
13 | mile radius of the proposed keystone opportunity zone, |
14 | proposed keystone opportunity expansion zone, proposed |
15 | subzone or proposed expansion subzone in an urban area is |
16 | deteriorated. |
17 | (7) In an urban area, the median family income is 80% or |
18 | less of the urban median family income for that metropolitan |
19 | statistical area. |
20 | (8) In an area other than an urban area, the median |
21 | family income is 80% or less of the Statewide nonurban median |
22 | family income. |
23 | (9) The population loss exceeds 10% in an area that |
24 | includes the proposed keystone opportunity zone or proposed |
25 | keystone opportunity expansion zone and its surrounding area |
26 | but is not larger than the county or counties in which the |
27 | proposed keystone opportunity zone or proposed keystone |
28 | opportunity expansion zone is located, based on census data |
29 | for the period between 1980 and 1990 or census estimates |
30 | since 1990 establishing a pattern of population loss. |

1 | (10) The political subdivision in which the proposed |
2 | keystone opportunity zone or proposed keystone opportunity |
3 | expansion zone is located has experienced a sudden and/or |
4 | severe job loss. |
5 | (11) At least 33% of the real property in a proposed |
6 | keystone opportunity zone or proposed keystone opportunity |
7 | expansion zone in a nonurban area would otherwise remain |
8 | underdeveloped or nonperforming due to physical |
9 | characteristics of the real property. |
10 | (12) The area has substantial real property with |
11 | adequate infrastructure and energy to support new or expanded |
12 | development. |

14 | Section 5. The act is amended by adding a section to read: |
15 | Section 1101.1. Duties of department. |
16 | The department shall provide, upon request, the appropriate |
17 | staff to rural areas to implement keystone opportunity zones. |
18 | Section 6. Section 1102 of the act, amended December 20, |
19 | 2000 (P.L.841, No.119), is amended to read: |
20 | Section 1102. Reporting. |
21 | The department shall report to the General Assembly on the |
22 | economic effects of this act in each keystone opportunity zone |
23 | or keystone opportunity expansion zone every [four years] year. |
24 | Section 7. The amendment of the definition of "business" in |
25 | section 103 of the act shall apply prospectively, beginning on |
26 | the effective date of this section, and shall neither be |
27 | construed to nullify a tax benefit obtained prior to the |
28 | effective date of this section nor result in any change to the |
29 | tax status of a business that qualified for special tax benefits |
30 | prior to the amendment of the definition of "business" in |

2 | Section 8. This act shall take effect in 60 days. |
