A JOINT RESOLUTION

Proposing an amendment to the Constitution of the Commonwealth

2

of Pennsylvania, authorizing a Constitutional Convention.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby resolves as follows:

5

Section 1.  The following amendment to the Constitution of

6

Pennsylvania is proposed in accordance with Article XI:

7

That Article XI be amended by adding a section to read:

8

§ 2.  Constitutional Convention.

9

(a)  By a majority vote of both Houses, the General Assembly

10

may provide for the submission to the qualified electors of this

11

Commonwealth at the next general election the following

12

question:

Shall a Constitutional Convention be called in accordance

14

with act (fill in number) of (fill in year), to prepare

15

for submission to the electorate proposals for the

16

revision of (fill in the provisions to be revised) of the

17

Constitution of Pennsylvania?

If a majority of those voting on the question decide in favor

2

of a Convention, the Secretary of the Commonwealth shall provide

3

for the election of Convention delegates at the next general

4

election.

5

(b)  The Convention shall be composed of 150 delegates. The

6

qualified electors of each senatorial district shall elect three

7

delegates. The qualifications of delegates shall be the same as

8

those of members of the Senate.

9

(c)  The delegates elected shall convene in the Hall of the

10

House of Representatives on the first Tuesday in April after

11

their election.

12

(d)  Every delegate shall receive compensation as shall be

13

provided by law for their services.

14

(e)  A majority of the Convention shall constitute a quorum

15

for conducting business.

16

(f)  The Convention shall have the power to appoint officers,

17

employees and assistants as it may deem necessary and to fix

18

their compensation.

19

(g)  The Convention may provide for the printing and

20

electronic posting of its documents, journals, debates and

21

proceedings and other expenses necessary for conducting the

22

Convention.

(h)  Whenever there is a delegate vacancy, a special election

24

shall be provided for and the vacancy shall be filled by the

25

qualified electors of the district.

(i)  No proposed amendment to the Constitution adopted by the

27

Convention shall be submitted for approval unless by assent of a

28

majority of the elected delegates serving in the Convention.

A proposed amendment which has been adopted by the Convention

30

shall be submitted to a vote by the qualified electors of this

Commonwealth.

If more than one amendment is submitted at a general

3

election, each shall be voted upon separately. Upon the approval

4

of an amendment by a majority of qualified electors, it shall

5

take effect on the first day of January after the approval.

Section 2.  (a)  Upon the first passage by the General

7

Assembly of this proposed constitutional amendment, the

8

Secretary of the Commonwealth shall proceed immediately to

9

comply with the advertising requirements of section 1 of Article

10

XI of the Constitution of Pennsylvania and shall transmit the

11

required advertisements to two newspapers in every county in

12

which such newspapers are published in sufficient time after

13

passage of this proposed constitutional amendment.

(b)  Upon the second passage by the General Assembly of this

15

proposed constitutional amendment, the Secretary of the

16

Commonwealth shall proceed immediately to comply with the

17

advertising requirements of section 1 of Article XI of the

18

Constitution of Pennsylvania and shall transmit the required

19

advertisements to two newspapers in every county in which such

20

newspapers are published in sufficient time after passage of

21

this proposed constitutional amendment. The Secretary of the

22

Commonwealth shall submit this proposed constitutional amendment

23

to the qualified electors of this Commonwealth at the first

24

primary, general or municipal election which meets the

25

requirements of and is in conformance with section 1 of Article

26

XI of the Constitution of Pennsylvania and which occurs at least

27

three months after the proposed constitutional amendment is

28

passed by the General Assembly.
