AN ACT

Amending the act of April 9, 1929 (P.L.343, No.176), entitled,

2

as amended, "An act relating to the finances of the State

3

government; providing for the settlement, assessment,

4

collection, and lien of taxes, bonus, and all other accounts

5

due the Commonwealth, the collection and recovery of fees and

6

other money or property due or belonging to the Commonwealth,

7

or any agency thereof, including escheated property and the

8

proceeds of its sale, the custody and disbursement or other

9

disposition of funds and securities belonging to or in the

10

possession of the Commonwealth, and the settlement of claims

11

against the Commonwealth, the resettlement of accounts and

12

appeals to the courts, refunds of moneys erroneously paid to

13

the Commonwealth, auditing the accounts of the Commonwealth

14

and all agencies thereof, of all public officers collecting

15

moneys payable to the Commonwealth, or any agency thereof,

16

and all receipts of appropriations from the Commonwealth,

17

authorizing the Commonwealth to issue tax anticipation notes

18

to defray current expenses, implementing the provisions of

19

section 7(a) of Article VIII of the Constitution of

20

Pennsylvania authorizing and restricting the incurring of

21

certain debt and imposing penalties; affecting every

22

department, board, commission, and officer of the State

23

government, every political subdivision of the State, and

24

certain officers of such subdivisions, every person,

25

association, and corporation required to pay, assess, or

26

collect taxes, or to make returns or reports under the laws

27

imposing taxes for State purposes, or to pay license fees or

28

other moneys to the Commonwealth, or any agency thereof,

29

every State depository and every debtor or creditor of the

30

Commonwealth," further providing for use and appropriation of

31

unused Commonwealth funds.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 1508 of the act of April 9, 1929

4

(P.L.343, No.176), known as The Fiscal Code, added July 17, 2007

5

(P.L.141, No.42), is amended to read:

6

Section 1508.  Use and Appropriation of Unused Commonwealth

7

Funds.--(a)  The following apply:

8

(1)  Whenever the Governor has declared a disaster emergency,

9

the Governor may transfer any unused funds which may have been

10

appropriated for the ordinary expenses of the State government

11

in the General Fund to such Commonwealth agencies as the

12

Governor may direct to be expended for relief of disaster in

13

such manner as the Governor shall approve[, and the].

14

(2)  For the payment of officers and employes of the

15

Commonwealth who are subject to 51 Pa.C.S. § 4102(b) (relating

16

to leaves of absence for certain government employees), the

17

Governor may transfer any unused funds which may have been

18

appropriated for the ordinary expenses of the State government

19

in the General Fund to such Commonwealth agencies as the

20

Governor may direct to be expended for the purposes set forth in

21

51 Pa.C.S. § 4102(b) in such manner as the Governor shall

22

approve.

(3)  The funds referred to in clauses (1) and (2) are hereby

24

appropriated to the Governor for [such] the specified purposes.

25

(4)  The total of the transfers under this subsection shall

26

not exceed twenty million dollars ($20,000,000) in any one

27

fiscal year except by action of the General Assembly.

(b)  Whenever the Governor shall have proclaimed a disaster

29

emergency under 35 Pa.C.S. § 7301(c) (relating to general

30

authority of Governor), the Governor shall have power to

transfer any unused funds which may have been appropriated for

2

the ordinary expenses of government in the General Fund to such

3

Commonwealth agencies as he may direct to be expended for

4

reimbursements as provided in 35 Pa.C.S. § 7705(a) and (b) 

5

(relating to special powers of local agencies). Such

6

reimbursements shall be made in accordance with and to the

7

extent permitted by regulations issued by such agency or

8

agencies as the Governor may designate to administer the

9

reimbursement programs established by 35 Pa.C.S. § 7705(a) and

10

(b). The total of such transfers shall never exceed five million

11

dollars ($5,000,000) in any one fiscal year except by action of

12

the General Assembly.

Section 2.  This act shall take effect immediately.
