AN ACT

  

1

Amending Title 65 (Public Officers) of the Pennsylvania

2

Consolidated Statutes, further providing for restricted

3

activities.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1103(i) of Title 65 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1103.  Restricted activities.

(i)  Former executive-level employee.--

11

(1)  No former executive-level State employee may for a

12

period of two years from the time that he terminates

13

employment with this Commonwealth be employed by, receive

14

compensation from, assist or act in a representative capacity

15

for a business or corporation that he actively participated

16

in recruiting to this Commonwealth or that he actively

17

participated in inducing to open a new plant, facility or

18

branch in this Commonwealth or that he actively participated

in inducing to expand an existent plant or facility within

2

this Commonwealth, provided that the above prohibition shall

3

be invoked only when the recruitment or inducement is

4

accomplished by a grant or loan of money or a promise of a

5

grant or loan of money from the Commonwealth to the business

6

or corporation recruited or induced to expand.

(2)  No former executive-level State employee having

8

responsibilities related to the awarding of contracts by a

9

State agency, the development of policies or requirements

10

relating to a contract, the negotiation of a contract or

11

other participation in the development or award of a contract

12

shall do any of the following until at least two years

13

subsequent to termination of employment:

14

(i)  Seek or accept employment with an entity that

15

has entered into or intends to enter into a contract with

16

that State agency.

17

(ii)  Represent, before an agency or the Governor's

18

Office, a person that has entered into or intends to

19

enter into a contract with the State agency with which

20

the former executive-level State employee was associated.

21

(3)  No employee of a person who has a contract with a

22

State agency and who becomes an executive-level employee of a

23

State agency may participate in the award or negotiation of a

24

contract or the development or implementation of requirements

25

relating to a contract with the executive-level's former

26

employee.

Section 2.  This act shall take effect in 60 days.
