AN ACT
Requiring the Pennsylvania State Police to conduct criminal
background checks requested by an employer.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Criminal
Background Check Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Criminal background check." A criminal background check of
any resident of this Commonwealth conducted at the request of an
employer.
Section 3. Pennsylvania State Police.
Notwithstanding any other provision of law and except for
criminal background checks conducted by a Federal, State or
local governmental agency, the Pennsylvania State Police shall
conduct all criminal background checks.
Section 10. Effective date.
This act shall take effect in 60 days.
