AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, providing for

3

confidential communications to peer support members and for

4

confidential communications to critical incident stress

5

management team member.

6

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 42 of the Pennsylvania Consolidated

9

Statutes is amended by adding sections to read:

10

§ 5945.3.  Confidential communications to peer support members.

11

(a)  Definitions.--As used in this section, the following

12

words and phrases shall have the meanings given to them in this

13

subsection:

14

"Confidential communication."  All information, oral or

15

written, transmitted between a public employee and a peer

16

support member or critical incident stress management team

17

member in the course of their relationship, including, but not

18

limited to, any advice, reports, statistical data, memoranda,

19

working papers, records or the like, given or made during that

relationship.

"Peer support member."  A public employee who is assigned by

3

a public employer and who receives a minimum of 24 hours of

4

basic training in peer services, including listening, assessment

5

and referral skills and basic critical incident stress

6

management. Peer support members shall receive eight hours of

7

continuing training each year and may be supervised by licensed

8

psychologists.

"Public employee" or "employee."  An individual employed by a

10

public employer.

11

"Public employer."  The Commonwealth of Pennsylvania, its

12

political subdivisions, including school districts and any

13

officer, board, commission, agency, authority or other

14

instrumentality thereof, and any nonprofit organization or

15

institution and any charitable, religious, scientific, literary,

16

recreational, health, educational or welfare institution

17

receiving grants or appropriations from Federal, State or local

18

governments, but not including employers covered or presently

19

subject to coverage under the National Labor Relations Act (49

20

Stat. 449, 29 U.S.C. § 151 et seq.).

(b)  Privilege.--Except as provided under subsection (c), a

22

peer support member who, while in the course of his or her

23

duties, has acquired confidential information from a public

24

employee secretly and in confidence, shall not be compelled or

25

allowed without the consent of the public employee to disclose

26

that information in a legal proceeding, trial or investigation

27

before any government unit, nor examined relative to the

28

confidential information in any civil or criminal proceeding

29

without the written consent of the victim.

(c)  Exceptions.--The privilege established under subsection

(b) shall not apply if any of the following apply:

(1)  The communications to the peer support member

3

indicate a clear and present danger to the employee or to

4

other persons.

5

(2)  The employee who received peer support services

6

gives express consent to the disclosure or testimony.

7

(3)  The employee who received peer support services is

8

deceased and the surviving spouse or the executor or

9

administrator of the estate of the deceased employee gives

10

express consent.

11

(4)  The employee who received peer support services

12

voluntarily testifies, in which case the peer support member

13

may be compelled to testify on the same subject.

14

(5)  The court in camera determines that the confidential

15

information communicated by the employee who received peer

16

support services is not germane to the relationship between

17

the employee and peer support member.

18

(6)  The confidential communication or advice pertains or

19

is related to a serious crime.

20

§ 5945.4.  Confidential communications to critical incident

21

stress management team member.

22

(a)  Definitions.--As used in this section, the following

23

words and phrases shall have the meanings given to them in this

24

subsection:

25

"Crisis response services."  Consultation, risk assessment,

26

referral and onsite crisis intervention services provided by a

27

critical incident stress management team to a public safety

28

responder who has experienced a critical incident in the course

29

and scope of their duties.

30

"Critical incident."  A situation responded to by a public

safety responder that involves either the death or serious

2

bodily injury of an individual or the imminent potential of

3

death or serious bodily injury, or any situation faced by safety

4

personnel in the course of their duties that causes them to

5

experience unusually strong negative emotional reactions that

6

have the potential to interfere with their ability to function

7

in a well adjusted, productive manner.

8

"Critical incident stress defusing and debriefing process." A

9

process involving defusings and debriefings that is based on

10

crisis intervention theory and educational intervention theory

11

rendered by a critical incident stress management team member

12

during or after a critical incident.

13

"Critical incident stress management team member."  A person

14

specially trained to provide crisis response services to public

15

safety responders in a critical incident.

16

"Public safety responder."  A person under the operational

17

control of the Commonwealth, a political subdivision of the

18

Commonwealth or a police, volunteer fire, emergency, paramedic

19

or ambulance service, who in the early stages of a critical

20

incident are responsible for the protection and preservation of

21

life, property, evidence and the environment, including

22

emergency response providers as defined in section 2 of the

23

Homeland Security Act of 2002 (Public Law 107-296, 116 Stat.

24

2135), and emergency management, public health, clinical care,

25

public works and other skilled support personnel who provide

26

immediate support services during prevention, response and

27

recovery operations.

28

(b)  Confidential communications.--Except as provided under

29

subsection (c), a critical incident stress management team

30

member who, while in the course of his duties, has acquired

information from any public safety responder secretly and in

2

confidence in connection with a critical incident during a

3

critical incident stress defusing and debriefing process, shall

4

not be compelled or allowed without the consent of the public

5

safety responder to disclose that information in an internal or

6

external investigation, legal proceeding or trial before any

7

government unit, agency or employer.

8

(c)  Exceptions.--The privilege established under subsection

9

(b) shall not apply if any of the following apply:

10

(1)  The communications to the critical incident stress

11

management team member indicate a clear and present danger to

12

the public safety responder who receives crisis response

13

services or to other persons.

14

(2)  The public safety responder who received crisis

15

response services gives express consent to the testimony.

16

(3)  The public safety responder who received crisis

17

response services is deceased and the surviving spouse or the

18

executor or administrator of the estate of the deceased

19

public safety responder gives express consent.

20

(4)  The public safety responder who received crisis

21

response services voluntarily testifies, in which case the

22

critical incident stress management team member may be

23

compelled to testify on the same subject.

24

(5)  The court in camera determines that the information

25

communicated by the public safety responder who received

26

crisis response services is not germane to the relationship

27

between the public safety responder and the critical incident

28

stress management team member.

29

(6)  The communication or advice pertains or is related

30

to any criminal act.
