AN ACT

Amending the act of June 24, 1931 (P.L.1206, No.331), entitled

2

"An act concerning townships of the first class; amending,

3

revising, consolidating, and changing the law relating

4

thereto," repealing provisions relating to failure of

5

township officer to perform duties.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 604 of the act of June 24, 1931

9

(P.L.1206, No.331), known as The First Class Township Code,

10

reenacted and amended May 27, 1949 (P.L.1955, No.569), is

11

repealed:

[Section 604.  Failure of Officer to Perform Duties.--If any

13

township officer refuses or neglects to perform his duties, the

14

court of quarter sessions, upon complaint in writing by one

15

hundred citizens, owners of real estate residing in the

16

township, may issue a rule upon such officer to show cause why

17

his office should not be declared vacant and another appointed

18

in his stead. Such rule shall be made returnable not less than

19

two weeks from its date of issue. Upon hearing and proof that

the facts alleged in the complaint are true, the court may

2

declare the office vacant and appoint another in his stead, to

3

hold office for the unexpired term.]

Section 2.  This act shall take effect in 60 days.
