A RESOLUTION

Directing the Joint State Government Commission to conduct a

2

study of efficiency in public school funding and urging the

3

State Board of Education to provide documents and assistance

4

to the Joint State Government Commission in its conduct of

5

this study.

WHEREAS, Pursuant to section 2599.3 of the act of March 10,

7

1949 (P.L.30, No.14), known as the Public School Code of 1949,

8

the State Board of Education is directed to conduct a

9

comprehensive Statewide costing-out study for public education

10

funding, which duty was added to the Public School Code of 1949

11

by the act of July 11, 2006 (P.L.1092, No.114); and

12

WHEREAS, The State Board of Education was conferred the

13

discretion in section 2599.3 of the Public School Code of 1949

14

to hire a consultant to perform the study; and

15

WHEREAS, The State Board of Education contracted with

16

Augenblick, Palaich and Associates, Inc., (APA) of Denver,

17

Colorado, to conduct the study; and

WHEREAS, The legislative intent for the study was to examine

2

issues of adequacy and equity in public school funding and to

3

determine the basic cost per pupil to provide an education that

4

will permit a student to meet the Commonwealth's academic

5

standards and assessments; and

6

WHEREAS, Section 2599.3 of the Public School Code of 1949

7

specifically requires the study to examine "exemplary school

8

districts that are high-performing and low-spending school

9

districts," but section 2599.3 does not explicitly mandate other

10

methodologies to be applied in the study; and

11

WHEREAS, The study conducted by APA subsequently used three

12

methodologies: a "Successful Schools" approach that was

13

consistent with the explicit requirements of section 2599.3 of

14

the Public School Code of 1949, but also two additional

15

methodologies referred to as "Professional Judgment" panels and

16

"Evidence-Based" research that were not required under law; and

17

WHEREAS, The final report issued to the Commonwealth by APA

18

used a combination of all three of these methodologies to

19

recommend specific dollar amounts for the basic cost per pupil,

20

plus additional weights and other modifications that increase

21

the basic cost per pupil; and

22

WHEREAS, The final report does not provide any indication as

23

to how the three methodologies were combined or compared against

24

one another, nor does it provide any other information detailing

25

how the specific recommended numbers in its findings were

26

actually calculated in the study; and

27

WHEREAS, Both the State Board of Education and APA testified

28

to the Education Committee of the Senate on December 8, 2009,

29

that the specific methodology applied to derive the final

30

funding recommendation cannot be disclosed to the General

Assembly because APA believes the methodology is proprietary

2

information; and

3

WHEREAS, The results of the study call for an additional

4

target of $4.61 billion annually of taxpayer funds for public

5

school funding, or a 26.8% increase, but APA testified that it

6

cannot provide the quantitative numbers used to justify this

7

target; and

8

WHEREAS, The "Successful Schools" approach used by APA in the

9

study was the only methodology that was explicitly authorized in

10

section 2599.3 of the Public School Code of 1949 because it

11

focused on high-performing and low-spending school districts;

12

and

13

WHEREAS, The Commonwealth should focus its attention toward

14

the most efficient use of the dollars already available for

15

public schools; and

16

WHEREAS, The Commonwealth should build upon the work already

17

conducted in the original costing-out study by examining the

18

schools identified in the report under the "Successful Schools"

19

methodology to learn their best practices and other factors that

20

have resulted in their identification as a high-performing, low-

21

spending school district; therefore be it

22

RESOLVED, That the House of Representatives direct the Joint

23

State Government Commission to conduct a study of the 82 school

24

districts found to be successful schools in the APA costing-out

25

study and to issue a report to the chairman of the Education

26

Committee of their best practices and other factors that are

27

believed to help contribute to this recognized efficiency and

28

success; and be it further

29

RESOLVED, That the State Board of Education be urged to

30

cooperate fully with the Joint State Government Commission in

providing documentation from the original costing-out study and

2

other assistance as the Joint State Government Commission

3

requests; and be it further

4

RESOLVED, That the report from the Joint State Government

5

Commission be submitted to the chairman of the Education

6

Committee no later than November 1, 2010; and be it further

7

RESOLVED, That the final report serve as the basis for future

8

deliberations by the House of Representatives on the

9

Commonwealth's basic education funding levels and components.
