| A RESOLUTION |
| |
1 | Memorializing the President and the Congress of the United |
2 | States to enact legislation that will require companies who |
3 | engage in trade credit to remit full payment to the supplier |
4 | for any services or products within 30 days of receipt of the |
5 | itemized invoice from the supplier. |
6 | WHEREAS, A small business is defined by the United States |
7 | Small Business Administration as a company that employs fewer |
8 | than 500 employees; and |
9 | WHEREAS, According to the United States Small Business |
10 | Administration, there are approximately 240,000 small businesses |
11 | in the Commonwealth of Pennsylvania; and |
12 | WHEREAS, Small businesses comprise a large component that |
13 | helps to fuel the engine of Pennsylvania's economy; and |
14 | WHEREAS, Small businesses have been adversely affected by the |
15 | recent economic downturn; and |
16 | WHEREAS, Research studies indicate that three out of five |
17 | small businesses indulge in the practice known as "trade credit" |
18 | - a financing mechanism whereby businesses arrange to purchase |
19 | services or products without making an immediate cash payment; |

2 | WHEREAS, The practice of trade credit is essential to the |
3 | economic stability and growth of many businesses as bank credit |
4 | has become increasingly more difficult to attain; and |
5 | WHEREAS, Businesses that act as the lender in trade credit |
6 | transactions typically require that payment is made in full |
7 | within 30 days from the date of the itemized invoice; and |
8 | WHEREAS, Recent data indicate that some multibillion dollar |
9 | companies withhold payment to their suppliers at upwards of 120 |
10 | days; and |
11 | WHEREAS, Small businesses have been forced to scale back on |
12 | hiring and training new employees as a result of receiving |
13 | untimely payment from corporate customers; therefore be it |
14 | RESOLVED, That the House of Representatives of Pennsylvania |
15 | urge the President and the Congress of the United States to |
16 | enact legislation that will require companies who engage in |
17 | trade credit to remit full payment to the supplier for any |
18 | services or products within 30 days of receipt of the itemized |
19 | invoice from the supplier; and be it further |
20 | RESOLVED, That a copy of this resolution be transmitted to |
21 | the President of the United States, the presiding members of |
22 | each chamber of Congress, the Pennsylvania Congressional |
23 | Delegation and the United States Small Business Administration. |
