A CONCURRENT RESOLUTION

Urging the Supreme Court of Pennsylvania to revise the Rules of

Civil Procedure to provide for temporary relief for mortgage

3

foreclosure.

WHEREAS, The mortgage foreclosure on residential housing is

5

causing a serious housing crisis in this Commonwealth; and

6

WHEREAS, The United States Department of Housing and Urban

7

Development is developing a "bridge-loan" program to assist

8

mortgagors affected by the crisis; and

9

WHEREAS, It is possible that a stay of foreclosures on

10

residential housing in the poorest areas of this Commonwealth,

11

pending Federal action addressing relief for impoverished

12

residential mortgagors, be addressed in the context of an

13

amendment to Pa.R.C.P. No. 3183 (relating to stay of execution

14

and setting aside execution); therefore be it

15

RESOLVED (the Senate concurring), That the General Assembly

16

urge the Supreme Court of Pennsylvania to amend Pa.R.C.P. No.

17

3183 (relating to stay of execution and setting aside execution)

18

to provide for a temporary stay of execution on residential

mortgages of impoverished mortgagors, pending implementation of

2

Federal action addressing relief for impoverished residential

3

mortgagors; and be it further

4

RESOLVED, That a copy of this resolution be transmitted to

5

the Administrative Office of Pennsylvania Courts.
