AN ACT

Amending Title 23 (Domestic Relations) of the Pennsylvania

2

Consolidated Statutes, providing for an exception to the

3

marriage license period for members of the active military,

4

reserves or Pennsylvania National Guard who are currently

5

deployed in an active military operation or emergency.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 1310 of Title 23 of the Pennsylvania

9

Consolidated Statutes is amended to read:

10

§ 1310.  Duration and form of license.

11

[The] (a)  General rule.--A marriage license shall not be

12

valid [for a longer period] more than 60 days from the date of

13

issue and shall be in substantially the following form:

14

Commonwealth of Pennsylvania

15

To any person authorized by law to solemnize marriage:

You are hereby authorized to join together in holy state of

3

matrimony, according to the laws of the Commonwealth of

4

Pennsylvania, (name) and (name).

Given under my hand and seal of the Court of Common Pleas of

(name), at (city, borough or town), on (date).

(b)  Exception.--If an applicant is unable to satisfy the 60-

10

day license requirement under this section due to his deployment

11

for active military service, the applicant shall be granted an

12

additional 60 days following his return from active military

13

service.

14

(c)  Definition.--As used in this section, the term "active

15

military service" means active service in any of the armed

16

forces of the United States or its reserve components for a

17

period of 30 or more consecutive days in response to a war,

18

armed conflict or state of emergency.

Section 2.  This act shall take effect immediately.
