| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, providing for global |
3 | positioning satellite units. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 42 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 9722.1. Global positioning satellite unit. |
9 | (a) A court may require that an individual wear a global |
10 | positioning satellite unit, with the victim's consent, if the |
11 | defendant has knowledge of the location of the victim's |
12 | residence, place of employment or school and has one of the |
13 | following orders in place: |
14 | (1) A peace order under section 6204 (relating to |
15 | emergency orders), 6205 (relating to temporary orders), 6206 |
16 | (relating to hearing) or 6211 (relating to foreign orders). |
17 | (2) A protection from abuse order under 23 Pa.C.S. |

1 | Ch. 61 (relating to protection from abuse). |
2 | (b) When a defendant is required to wear a global |
3 | positioning satellite unit, the court shall establish a |
4 | prohibited zone that shall be narrowly tailored to best protect |
5 | the victim. If the defendant enters this prohibited zone, the |
6 | global positioning satellite unit shall alert the victim, law |
7 | enforcement officials and the county emergency management |
8 | center. The officials shall have the authority to arrest the |
9 | defendant for violating the orders listed in subsection (a). |
10 | Section 2. This act shall take effect in 60 days. |
