AN ACT

Authorizing leave of absence from employment for veterans on

Veterans Day.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

Section 1.  Definitions.

6

The following words and phrases when used in this act shall

7

have the meanings given to them in this section unless the

8

context clearly indicates otherwise:

"Employee."  A natural person who performs services for a

10

public or private employer for valuable consideration.

11

"Employer."  A person engaged in a business, industry,

12

profession, trade or other enterprise in this Commonwealth,

13

including, but not limited to, a natural person, partnership,

14

joint-stock company, corporation for profit, corporation not-

15

for-profit, municipal corporation, the Commonwealth and any

16

government agency established by it.

Section 2.  Veterans Day holiday.

(a)  General rule.--Any employee who is an honorably

3

discharged veteran of the United States or a reserve component

4

of the armed forces as defined in 51 Pa.C.S. § 7301 (relating to

5

definitions) shall be entitled to a leave of absence from the

6

employee's respective duties without loss of seniority or other

7

employment benefit or advantage on Veterans Day. Such leave

8

shall be paid or unpaid at the discretion of the employer.

(b)  Documentation.--An employer may require documentation of

10

veteran status for an employee under subsection (a).

Section 3.  Effective date.

12

This act shall take effect in 60 days.
