AN ACT

Amending the act of April 21, 1949 (P.L.665, No.155), entitled

2

"An act to carry into effect section one of article fifteen

3

of the Constitution, giving cities of the first class the

4

right and power to frame, adopt and amend their own charters

5

and to exercise the powers and authority of local self-

6

government, and providing the procedure therefor; imposing

7

certain restrictions, limitations and regulations; imposing

8

duties upon city councils, city officers, county boards of

9

elections, courts and the Secretary of the Commonwealth; and

10

providing for the payment of certain expenses by such cities;

11

and imposing penalties," providing for first class city

12

delinquent payments.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

15

Section 1.  The act of April 21, 1949 (P.L.665, No.155),

16

known as the First Class City Home Rule Act, is amended by

17

adding a section to read:

Section 19.1.  First Class City Delinquent Payments.

19

(a)  The following shall apply to delinquent payments:

20

(1)  Once before a contract is awarded and again at the end

21

of the contract, the school district shall require each person

22

or business to submit a form:

(i)  Certifying that the person or business does not have

2

delinquent city, State or Federal taxes.

3

(ii)  Authorizing the commissioner of the procurement

4

department to disclose to the head of the school district,

5

information limited to describing whether the person or business

6

has delinquent taxes.

(b)  If the school district determines that a person or

8

business does have delinquent taxes while on contract with the

9

school district, the school district shall withhold payments

10

until such person or business makes payment arrangements with

11

the procurement department.

(c)  The procurement department shall make available to the

13

school district a standard form for the certification and

14

authorization described in subsection (a).

15

(d)  Definitions.--As used in this section, the following

16

words and phrases shall have the meanings given to them in this

17

subsection unless the context clearly indicates otherwise:

18

"Business."  As defined in section 1 of the act of May 23,

19

1949 (P.L.1669, No.508), referred to as the First Class School

20

District Business Tax Act.

21

"Contract."  An agreement between a person and the school

22

district.

23

"Delinquent taxes."  The term includes all delinquent taxes,

24

whether or not liens have been filed in the office of the county

25

prothonotary, and all penalties, interest and costs due on the

26

delinquent taxes.

"Procurement department."  The City of Philadelphia

28

Procurement Department.

29

"School district."  A school district of the first class.

30

"Tax year."  The twelve-month period from January 1 to

Section 2.  This act shall take effect in 60 days.
