AN ACT

Providing for lapsing of all prior year appropriations into the

2

General Fund, for continuing appropriations and for emergency

3

spending authority.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Appropriations.

7

The Majority Leader and Minority Leader of the Senate and the

8

Majority Leader and Minority Leader of the House of

9

Representatives shall lapse all prior year appropriations into

10

the General Fund.

11

Section 2.  Continuing appropriations.

12

The General Assembly shall not provide for the continuing

13

appropriation of funds which are unexpended, uncommitted or

14

unencumbered at the end of the Commonwealth's fiscal year.

15

Section 3.  Emergency spending authority.

Despite the provisions of Article III, section 24 of the

17

Constitution of Pennsylvania, when budget appropriations are not

timely adopted before the beginning of the Commonwealth's fiscal

2

year, the General Assembly shall have the authority to pay

3

emergency operating expenses as defined by the Bi-partisan

4

Management Committee and the Committee of Management Operations

5

for members of the Senate. Payments made under this section

6

shall first be authorized by the President pro tempore of the

7

Senate and the Speaker of the House of Representatives.

8

Section 20.  Effective date.

9

This act shall take effect in 30 days.
