AN ACT

  

1

Amending the act of January 24, 1966 (1965 P.L.1535, No.537),

2

entitled, as amended, "An act providing for the planning and

3

regulation of community sewage systems and individual sewage

4

systems; requiring municipalities to submit plans for systems

5

in their jurisdiction; authorizing grants; requiring permits

6

for persons installing such systems; requiring disclosure

7

statements in certain land sale contracts; authorizing the

8

Department of Environmental Resources to adopt and administer

9

rules, regulations, standards and procedures; creating an

10

advisory committee; providing remedies and prescribing

11

penalties," further providing for official plans.

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Section 5(a) of the act of January 24, 1966 (1965

15

P.L.1535, No.537), known as the Pennsylvania Sewage Facilities

16

Act, amended December 14, 1994 (P.L.1250, No.149), is amended to

17

read:

Section 5.  Official Plans.--(a)  (1)  Each municipality

19

shall submit to the department an officially adopted plan for

20

sewage services for areas within its jurisdiction within such

21

reasonable period as the department may prescribe, and shall

from time to time submit revisions of such plan as may be

2

required by rules and regulations adopted hereunder or by order

3

of the department: Provided, however, That a municipality may at

4

any time initiate and submit to the department revisions of the

5

said plan. Revisions shall conform to the requirements of

6

subsection (d) of this section and the rules and regulations of

7

the department.

(2)  Each municipality shall, at least thirty days prior to

9

holding the required public hearing considering revisions to the

10

municipality's plan for sewage services to the department,

11

notify in writing each property owner in areas where community

12

sewage systems are planned to be available within a ten-year

13

period. This notification shall include information as

14

appropriate that describes any requirements for a property owner

15

not part of a community sewage system to connect to such system.

Section 2.  This act shall take effect in 60 days.
