| AN ACT |
| |
1 | Amending the act of June 3, 1937 (P.L.1333, No.320), entitled |
2 | "An act concerning elections, including general, municipal, |
3 | special and primary elections, the nomination of candidates, |
4 | primary and election expenses and election contests; creating |
5 | and defining membership of county boards of elections; |
6 | imposing duties upon the Secretary of the Commonwealth, |
7 | courts, county boards of elections, county commissioners; |
8 | imposing penalties for violation of the act, and codifying, |
9 | revising and consolidating the laws relating thereto; and |
10 | repealing certain acts and parts of acts relating to |
11 | elections," in preparation for and conduct of primaries and | <-- |
12 | elections, further providing for regulations in force at |
13 | polling places; in primary and election expenses, defining |
14 | "prerecorded political message"; and further providing for |
15 | advertising. |
16 | The General Assembly of the Commonwealth of Pennsylvania |
17 | hereby enacts as follows: |
18 | Section 1. Section 1621 of the act of June 3, 1937 | <-- |
19 | (P.L.1333, No.320), known as the Pennsylvania Election Code, is |
20 | amended by adding a subsection to read: |
21 | Section 1. Section 1220(c) of the act of June 3, 1937 | <-- |

1 | (P.L.1333, No.320), known as the Pennsylvania Election Code, is |
2 | amended and the section is amended by adding a subsection to |
3 | read: |
4 | Section 1220. Regulations in Force at Polling Places.--* * * |
5 | (c) No person, when within the polling place, shall |
6 | electioneer [or solicit votes for any political party, political |
7 | body or candidate], nor shall any written or printed matter be |
8 | posted up within the said room, except as required by this act. |
9 | * * * |
10 | (g) As used in this section, the word "electioneer" shall |
11 | mean to attempt to persuade or influence a qualified elector to |
12 | vote for or against, or solicit votes for or against a |
13 | candidate, political party, political body or ballot question. |
14 | The term shall also mean to wear, exhibit or distribute any |
15 | label, sign, poster, badge, sticker, button, shirt, hat, article |
16 | of clothing or other item that identifies or indicates support |
17 | for or opposition to a candidate, political party, political |
18 | body or a ballot question or any other action that identifies or |
19 | indicates support for or opposition to a candidate, political |
20 | party, political body or a ballot question. |
21 | Section 2. Section 1621 of the act is amended by adding a |
22 | subsection to read: |
23 | Section 1621. Definitions.--As used in this article, the |
24 | following words have the following meanings: |

26 | (n) The words "prerecorded political message" shall mean a |
27 | prerecorded or synthesized voice message by: |
28 | (1) A political candidate or political party. |
29 | (2) A person when the content of the message advocates the |
30 | success or defeat of any candidate, party or measure at any |

1 | election or contains information about any candidate or party. |
2 | Section 2 3. Section 1638 of the act, added October 4, 1978 | <-- |
3 | (P.L.893, No.171), is amended to read: |
4 | Section 1638. Advertising.-- |
5 | (a) [Whenever] Except as provided under subsection (c), |
6 | whenever any person makes an expenditure for the purpose of |
7 | financing communications expressly advocating the election or |
8 | defeat of a candidate, or ballot questions, through any |
9 | broadcasting station, newspaper, magazine, outdoor advertising |
10 | facility, direct mailing, or any other type of general public |
11 | political advertising, such communication: |
12 | (1) If authorized by the candidate, his authorized political |
13 | committee or their agents, shall clearly and conspicuously state |
14 | that the communication has been authorized. |
15 | (2) If not authorized by a candidate, his authorized |
16 | political committee, or their agents, shall clearly and |
17 | conspicuously state the name of the person who made or financed |
18 | the expenditure for the communication, including, in the case of |
19 | a political committee the name of any affiliated or connected |
20 | organization. |
21 | (b) (1) No candidate for public office, or political |
22 | committee or party acting on his behalf, shall place any |
23 | advertisement referring to an opposing candidate for the same |
24 | office which is to be broadcast or published during the one |
25 | hundred and twenty (120) hours immediately prior to an election |
26 | or published in a weekly newspaper or periodical during the |
27 | eight (8) days immediately prior to an election, with a |
28 | television or radio broadcasting station, newspaper or |
29 | periodical, unless he has first given a copy of the material to |
30 | appear or be used in the advertisement and reasonable notice to |

1 | the opposing candidate and the county board of elections of the |
2 | county where the advertisement is to be placed in sufficient |
3 | time for a reply advertisement to be published or broadcast at |
4 | the same approximate time or in the same issue of the |
5 | publication or on the same radio or television broadcast as the |
6 | original advertisement and prior to the election in question. |
7 | (2) The reasonable notice referred to in clause (1) shall be |
8 | given in writing by registered mail, return receipt requested, |
9 | addressee signature only, with a true copy of the material |
10 | enclosed to appear or be used in the advertisement so as to |
11 | afford the recipient sufficient time to place a reply |
12 | advertisement to be published or broadcast at the same |
13 | approximate time or in the same issue of the publication or on |
14 | the same radio or television broadcast as the original |
15 | advertisement and prior to the election in question. |
16 | (3) Any person, firm or corporation, political committee or |
17 | party or member thereof, violating any of the provisions of this |
18 | section, shall be guilty of a misdemeanor, and upon conviction |
19 | thereof, shall be sentenced to pay a fine not exceeding one |
20 | thousand dollars ($1,000), or to undergo an imprisonment of not |
21 | less than one (1) month nor more than two (2) years, or both, in |
22 | the discretion of the court. |
23 | (c) Whenever any person makes an expenditure for the purpose |
24 | of financing communications to influence the outcome of an |
25 | election, through a prerecorded political message, such |
26 | communication: |
27 | (1) If authorized by the candidate, his authorized political |
28 | committee or their agents shall clearly and conspicuously state |
29 | the communication has been authorized. |
30 | (2) If not authorized by a candidate, his authorized |

1 | political committee or their agents shall clearly and |
2 | conspicuously state the name of the person who made or financed |
3 | the expenditure for the communication, including, in the case of |
4 | a political committee, the name of any affiliated or connected |
5 | organization. |
6 | Section 3 4. This act shall take effect in 60 days. | <-- |
