AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

municipal corporation portion of fines.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3573 of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 3573.  Municipal corporation portion of fines, etc.

9

(c.1)  Police services.--

11

(1)  A municipal corporation shall be reimbursed for

12

eligible police services performed by the police department

13

of the municipal corporation by individuals who are convicted

14

of and sentenced for a felony.

15

(2)  Rate of reimbursement for eligible police services

16

shall be set as follows:

17

(i)  Actual mileage for travel by motor vehicle shall

be reimbursed at a rate equal to the highest rate allowed

2

by the Internal Revenue Service. If travel is by other

3

than motor vehicle, reimbursement shall be for actual

4

vouchered travel expenses. If more than one defendant is

5

transported simultaneously, reimbursements shall be for

6

actual miles traveled, and the travel cost shall be

7

divided between or among the defendants who are convicted

8

and sentenced.

(ii)  Actual time for which the defendant is in

10

custody under the authority of the police department and

11

for attending an arraignment or court hearing for an

12

official purpose related to the prosecution of the

13

defendant shall be reimbursed at a rate of $13 per hour.

14

If more than one defendant is in custody for the same

15

incident simultaneously or if attendance is required at

16

an arraignment or court hearing for an official purpose

17

related to the prosecution of more than one defendant

18

simultaneously, reimbursements shall be for actual time,

19

and the cost shall be divided between or among the

20

defendants who are convicted and sentenced.

21

(3)  As used in this section, "eligible police services"

22

shall mean time and mileage associated with:

23

(i)  Taking a defendant into custody.

24

(ii)  Transporting a defendant from where the

25

defendant is taken into custody to where the defendant is

26

transferred to another authority or released.

27

(iii)  Attending an arraignment or court hearing for

28

an official purpose related to the prosecution of the

29

defendant.
