AN ACT

Amending Title 4 (Amusements) of the Pennsylvania Consolidated

2

Statutes, further providing for the definition of "gross

3

terminal revenue"; and providing for the definition of

4

"promotional credits."

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  The definition of "gross terminal revenue" in

8

section 1103 of Title 4 of the Pennsylvania Consolidated

9

Statutes, amended January 7, 2010 (P.L.1, No.1), is amended and

10

the section is amended by adding a definition to read:

§ 1103.  Definitions.

12

The following words and phrases when used in this part shall

13

have the meanings given to them in this section unless the

14

context clearly indicates otherwise:

"Gross terminal revenue."  The total of:

17

(1)  Cash or cash equivalent wagers received by a slot

18

machine minus the total of:

(i)  Cash or cash equivalents paid out to players as

2

a result of playing a slot machine, whether paid manually

3

or paid out by the slot machine.

4

(ii)  Cash or cash equivalents paid to purchase

5

annuities to fund prizes payable to players over a period

6

of time as a result of playing a slot machine.

7

(iii)  Any personal property distributed to a player

8

as a result of playing a slot machine. This does not

9

include travel expenses, food, refreshments, lodging or

10

services.

(2)  Cash received as entry fees for slot machine

12

contests or slot machine tournaments.

13

The term does not include counterfeit cash or tokens; coins or

14

currency of other countries received in slot machines, except to

15

the extent that the coins or currency are readily convertible to

16

cash; or cash taken in a fraudulent act perpetrated against a

17

slot machine licensee for which the licensee is not reimbursed.

No deduction from gross terminal revenue shall be allowed for

19

promotional credits or free play.

"Promotional credits."  Credits given by a licensed entity

22

and used by players allowing limited free play of slot machines.

Section 2.  This act shall take effect immediately.
