AN ACT

Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An

2

act relating to tax reform and State taxation by codifying

3

and enumerating certain subjects of taxation and imposing

4

taxes thereon; providing procedures for the payment,

5

collection, administration and enforcement thereof; providing

6

for tax credits in certain cases; conferring powers and

7

imposing duties upon the Department of Revenue, certain

8

employers, fiduciaries, individuals, persons, corporations

9

and other entities; prescribing crimes, offenses and

10

penalties," in sales and use tax, further providing for

11

exclusions from tax.

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Section 204 of the act of March 4, 1971 (P.L.6,

15

No.2), known as the Tax Reform Code of 1971, is amended by

16

adding a clause to read:

17

Section 204.  Exclusions from Tax.--The tax imposed by

section 202 shall not be imposed upon any of the following:

2

(67)  The sale at retail or use of components related to an

4

in-home advanced meter infrastructure with metering technology,

5

capable of bidirectional communication that records and allows

6

customers to monitor their electricity usage and electricity

7

prices on an hourly basis and of supporting the automatic

8

control of consumption of electricity by the customer or the

9

customer's utility on a voluntary basis. For the purposes of

10

this clause, "metering technologies" shall include:

11

(i)  Sensors,  wireless or mounted in smart cords, plugs or

12

breaker boxes.

13

(ii)  A base control unit, mounted in a router, built in a

14

separate desktop unit or added to a home computer.

15

(iii)  Remote controls or control repeaters, including wall-

16

mounted dashboards that repeat the information stored in a base

17

controller.

18

(iv)  A control logic Gateway which may reside in a base

19

control unit but may also reside in an end-user personal

20

Internet site to which a base control unit has access or the

21

meter itself.

22

(v)  An interface with the home electric meter which allows

23

end use and appliance control information to be exchanged

24

between the meter and a base control unit either locally or via

25

the Internet through an exchange between the local utility's

26

Internet site and the end-user's personal Internet site.

27

(vi)  A subscription to the utility's Internet-based

28

electricity account management site.

Section 2.  The Department of Revenue shall promulgate any

30

regulations it deems necessary to implement the provisions of

this act and shall cooperate with the Department of

Environmental Protection in ensuring adherence to any energy and

3

environmental standards or criteria associated with this act.

4

Section 3.  This act shall take effect immediately.
