| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for reports by police. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Section 3751(b) of Title 75 of the Pennsylvania |
6 | Consolidated Statutes is amended to read: |
7 | § 3751. Reports by police. |
8 | * * * |
9 | (b) Furnishing copies of report.-- |
10 | (1) Police departments shall, upon request, furnish a |
11 | certified copy of the full report of the police investigation |
12 | of any vehicle accident to any person involved in the |
13 | accident, his attorney or insurer, and to the Federal |
14 | Government, branches of the military service, Commonwealth |
15 | agencies, and to officials of political subdivisions and to |
16 | agencies of other states and nations and their political |
17 | subdivisions. |

1 | (2) Except as provided in paragraph (3), the cost of |
2 | furnishing a copy of a report under this subsection shall not |
3 | exceed [$15] $20. |
4 | (3) In a city of the first class, the cost of furnishing |
5 | a copy of a report under this subsection shall not exceed |
6 | $25. |
7 | (4) The copy of the report shall not be admissible as |
8 | evidence in any action for damages or criminal proceedings |
9 | arising out of a motor vehicle accident. |
10 | (5) Police departments may refuse to furnish the |
11 | complete copy of investigation of the vehicle accident |
12 | whenever there are criminal charges pending against any |
13 | persons involved in the vehicle accident unless the |
14 | Pennsylvania Rules of Criminal Procedure require the |
15 | production of the documents. |
16 | Section 2. This act shall take effect in 60 days. |
