| AN ACT |
| |
1 | Authorizing and directing the Department of General Services, |
2 | with the approval of the Governor, to grant and convey |
3 | certain lands situate in the 11th Ward, City of Harrisburg, |
4 | known as the Governor's Residence. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Conveyance in the City of Harrisburg, Dauphin |
8 | County. |
9 | (a) Authorization.--The Department of General Services, with |
10 | the approval of the Governor, is hereby authorized on behalf of |
11 | the Commonwealth of Pennsylvania to grant and convey, at a price |
12 | to be determined through competitive bidding, certain lands, |
13 | known as the Governor's Residence, situate in the 11th Ward of |
14 | the City of Harrisburg, Dauphin County. |
15 | (b) Description.--The property to be conveyed pursuant to |
16 | subsection (a) consists of approximately 3.2 acres and all |
17 | improvements thereon more particularly described as 2035 North |
18 | Front Street. |

1 | (c) Easements and encumbrances.--The conveyance shall be |
2 | made under and subject to all lawful and enforceable easements, |
3 | servitudes and rights of others, including, but not confined to, |
4 | streets, roadways and rights of any telephone, telegraph, water, |
5 | electric, gas or pipeline companies, as well as under and |
6 | subject to any lawful and enforceable estates or tenancies |
7 | vested in third persons appearing of record, for any portion of |
8 | the land or improvements erected thereon. |
9 | (d) Deed of conveyance.--The deed of conveyance shall be by |
10 | Special Warranty Deed and shall be executed by the Secretary of |
11 | General Services in the name of the Commonwealth of |
12 | Pennsylvania. |
13 | (e) Proceeds of sale.--The proceeds from the sale shall be |
14 | deposited in the General Fund. |
15 | (f) Restricted use.--The conveyance authorized under this |
16 | section shall be made under and subject to the condition, which |
17 | shall be contained in the deed of conveyance, that no portion of |
18 | the property conveyed shall be used as a licensed facility, as |
19 | defined in 4 Pa.C.S. § 1103 (relating to definitions), or any |
20 | other similar type of facility authorized under State law. The |
21 | condition shall be a covenant running with the land and shall be |
22 | binding upon the grantee, its successors and assigns. Should the |
23 | grantee, its successors or assigns, permit any portion of the |
24 | property authorized to be conveyed in this section to be used in |
25 | violation of this subsection, the title shall immediately revert |
26 | to and revest in the grantor. |
27 | Section 2. Repeals. |
28 | Repeals are as follows: |
29 | (1) The General Assembly declares that the repeal under |
30 | paragraph (2) is necessary to effectuate section 1 of this |

2 | (2) Section 4 of the act of March 31, 1949 (P.L.372, |
3 | No.34), known as The General State Authority Act of one |
4 | thousand nine hundred forty-nine, is repealed insofar as it |
5 | relates to the use of a public building in the City of |
6 | Harrisburg as the official residence of the Governor of the |
7 | Commonwealth. |
8 | Section 3. Effective date. |
9 | This act shall take effect immediately. |
