AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for duties of

3

Pennsylvania State Police.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6111.1(f) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended by adding paragraphs a

paragraph to read:

§ 6111.1.  Pennsylvania State Police.

(f)  Notification of mental health adjudication, treatment,

12

commitment, drug use or addiction.--

13

(4)  Within two business days of receipt of a

<--

15

notification under paragraph (1), the Pennsylvania State

16

Police shall notify the subject of the adjudication,

17

commitment or treatment Notwithstanding any statute to the

<--

contrary, judges of the courts of common pleas shall, within

2

15 days of an adjudication or involuntary commitment, give

3

written notice to any individual identified in paragraph (1)

4

(i) of the following:

5

(i)  The subject individual is prohibited from

<--

6

possession of firearms under the provisions of this

7

chapter.

8

(ii)  The subject individual has a reasonable period

<--

9

of time, not to exceed 60 days from the date of the

10

imposition of the disability, in which to sell or

11

transfer the subject’s individual's firearms to another

<--

12

eligible person who is not a member of the prohibited

13

person's household.

14

(iii)  The subject’s individual's firearm rights may

<--

15

be restored under section 6105(f)(1) (relating to persons

16

not to possess, use, manufacture, control, sell or

17

transfer firearms).

(5)  The notification provided to the subject of the

<--

19

adjudication, commitment or treatment under paragraph (4)

20

shall be sent by certified mail.

Section 2.  This act shall take effect in 90 days.
