AN ACT

Amending Title 62 (Procurement) of the Pennsylvania Consolidated

Statutes, in source procurement, further providing for

3

competitive sealed bidding.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 512(a) of Title 62 of the Pennsylvania

7

Consolidated Statutes is amended and the section is amended by

8

adding a subsection to read:

9

§ 512.  Competitive sealed bidding.

10

(a)  Conditions for use.--Contracts shall be awarded by

11

competitive sealed bidding except as otherwise provided in

12

subsection (i) or section 511 (relating to methods of source

13

selection).

(i)  Mandatory competitive bidding.--Every Commonwealth

16

agency, every independent Commonwealth agency, the State

17

Treasurer, the Attorney General, the Auditor General, the

General Assembly and all legislative agencies and the Judicial

2

Department shall use competitive bidding in awarding any

3

contract having an initial value in excess of $100,000. This

4

subsection shall also apply to the procurement of any legal

5

services having an initial value in excess of $100,000.

Section 2.  This act shall take effect January 1, 2010.
