| AN ACT |

1 | Amending Title 62 (Procurement) of the Pennsylvania Consolidated |
2 | Statutes, in source procurement, further providing for |
3 | competitive sealed bidding. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 512(a) of Title 62 of the Pennsylvania |
7 | Consolidated Statutes is amended and the section is amended by |
8 | adding a subsection to read: |
9 | § 512. Competitive sealed bidding. |
10 | (a) Conditions for use.--Contracts shall be awarded by |
11 | competitive sealed bidding except as otherwise provided in |
12 | subsection (i) or section 511 (relating to methods of source |
13 | selection). |

15 | (i) Mandatory competitive bidding.--Every Commonwealth |
16 | agency, every independent Commonwealth agency, the State |
17 | Treasurer, the Attorney General, the Auditor General, the |

1 | General Assembly and all legislative agencies and the Judicial |
2 | Department shall use competitive bidding in awarding any |
3 | contract having an initial value in excess of $100,000. This |
4 | subsection shall also apply to the procurement of any legal |
5 | services having an initial value in excess of $100,000. |
6 | Section 2. This act shall take effect January 1, 2010. |
