AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, providing for address change reporting.

3

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Title 75 of the Pennsylvania Consolidated

6

Statutes is amended by adding a section to read:

7

§ 1515.1.  Address change reporting.

8

(a)  General rule.--If the department receives information

9

through an affidavit of the owner of the property listed on a

10

person's application or driver's license that the person who

11

applied or received a driver's license or identification card

12

allegedly does not reside at that address, a letter shall be

13

sent by registered mail, return receipt requested, to the

14

individual requiring proof of residency within 15 days.

15

Acceptable proof of residency shall include the following:

16

(1)  A lease agreement.

17

(2)  A utility bill.

18

(3)  Any other documentation that links the person to

that address.

(b)  Cancellation.--If a person fails to respond or does not

3

present appropriate documentation or if mail is returned to the

4

department, the record shall be deemed canceled 15 days after

5

the department receives the return receipt from the registered

6

mail sent to the individual under subsection (a), and the

7

department shall place a code in the person's record so that no

8

activity such as a renewal or duplicate request may take place

9

until the residency requirement is met and verified by the

10

department's risk management office. Subject to the provisions

11

of any other law, the code shall be available to law enforcement

12

officials. The department shall notify the Department of State

13

and the county election bureau of the county in which the

14

address of the canceled record is located of the cancellation of

15

the record.

(c)  Official record.--After cancellation of the driver's

17

license or identification card by the department, the last known

18

address shall remain on the department's record as part of the

19

official record.

20

(d)  Penalty.--A person who knowingly submits a false

21

affidavit pursuant to subsection (a) commits a misdemeanor of

22

the third degree and shall, upon conviction, be sentenced to pay

23

a fine of $10,000.

24

Section 2.  This act shall take effect in 60 days.
